Data Licensing Policy
This Licensing Policy ("Licensing Policy") explains how dataset licensing works on the ATLAS-Data platform ("Site"), operated by AI Singapore. In this Licensing Policy, the words "we", "our", "us" and "AISG" refer to AI Singapore. "Data Providers" refer to third-party data providers and / or AISG (where relevant).
This Licensing Policy applies to all users ("Users") who access or otherwise use Dataset metadata, catalogue information, licensing references, APIs and related Dataset services made available through the Site, and to all Data Providers who make Dataset-related information available through the Site. Unless expressly stated otherwise, the Site does not itself provide, distribute or grant rights to download or use the underlying Dataset content.
Our Terms of Use ("Terms") and Privacy Policy are incorporated by way of reference. "You", "your" may refer to the User or third-party Data Provider, where relevant.
1. Data Licensing Model
The Datasets are made available under licenses chosen and provided by each Data Provider. The applicable license governing a Dataset is the End User Licence specified by the relevant rights holder for that Dataset. AISG does not impose a uniform licence across Datasets.
Where access to or use of Dataset content is made available, you enter into a licence relationship with the Data Provider that contributed that Dataset, governed by the licence that the Data Provider has applied to the Dataset.
2. No Platform Grant of Dataset Rights
Except where AISG is itself the Data Provider for a particular Dataset, AISG does not grant you any rights to use the Datasets through this Licensing Policy, our Terms, or otherwise. Your rights to use any Dataset arise solely from the license accompanying that Dataset, regardless of whether the Data Provider is a third party or AISG.
Before downloading or otherwise using a Dataset, you must review and accept the licence that the Data Provider has applied to that Dataset.
3. Third-Party Data Provider Obligations
When you contribute a Dataset to the Site, you represent and warrant that:
you have the legal right and authority to grant the license you have applied to the Dataset, including any necessary authorisation from data subjects, employers, funders, or rights holders;
the license text you have provided is accurate, complete, and not misleading;
the Dataset was lawfully collected, including in compliance with applicable data protection laws (such as Singapore's Personal Data Protection Act 2012 ("PDPA"), the EU/UK General Data Protection Regulation ("GDPR"), and any other laws applicable to you or to the data subjects);
the Dataset does not contain personal data unless you have a lawful basis for sharing it on the terms applied;
the Dataset does not infringe any third party's intellectual property, privacy, contractual, or other rights;
the Dataset does not contain malware, malicious code, or content designed to harm users or systems; and
you have provided accurate metadata about the Dataset, including any information necessary for users to comply with the license you have applied.
The third-party Data Provider retains ownership of or the appropriate licensing rights to any intellectual property rights it holds in the Dataset. By contributing the Dataset, you grant AISG a non-exclusive, royalty-free, worldwide licence to host, store, display, transmit, index, and make the information on the Dataset available to users on the terms you have specified, solely for the purpose of operating the Site. This license terminates when the cataloguing information on the Dataset is removed from the Site, except to the extent reasonably necessary to retain back-ups, audit logs, or other records for legal or operational purposes.
4. User Responsibilities
When you download and/or use a Dataset, you agree to:
read and comply with the license that the Data Provider has applied to that Dataset before downloading or otherwise using it;
- provide attribution as required by the applicable licence;
not attempt to re-identify any individual whose personal data has been anonymized or deidentified in the Dataset;
comply with all applicable laws, including data protection, intellectual property, export control, and sanctions laws;
comply with our Terms and Privacy Policy; and
acknowledge that, where the Data Provider for a Dataset is a third party (not AISG), AISG is not a party to your licence with that Data Provider and has no responsibility for any dispute between you and the Data Provider arising from your use of the Dataset.
5. Platform-Level Rules That Apply Regardless of Dataset Licence
Regardless of the licence that any Dataset is provided under, you must not:
attempt to re-identify any individual whose personal data has been anonymised or deidentified;
use the Site or any Dataset to harass, defame, threaten, or harm any individual;
- use the Site or any Dataset for any unlawful purpose;
- bypass, disable, or interfere with the security features of the Site;
introduce malware, viruses, or any other harmful code you make available to the Site or to Datasets;
redistribute Datasets in a manner inconsistent with the applicable licence; or
misrepresent the source, provenance, or licensing terms of any Dataset.
These rules apply in addition to the terms of each Dataset's license. To the extent any Dataset licence purports to permit conduct prohibited by this Section, the prohibition in this Section prevails as a condition of using the Site.
6. Disclaimers
AISG makes no representations or warranties about any Dataset made available through the Site, including (without limitation) as to the accuracy, completeness, reliability, suitability, legality, or quality of any Dataset, the validity or enforceability of any Dataset licence, or the rights of any Data Provider to make the Dataset available.
AISG does not review or validate Dataset licences on behalf of users. Users are responsible for satisfying themselves that they have the rights they need to use a Dataset for their intended purpose, and for understanding any conditions imposed by the applicable licence.
Cataloguing information on the Datasets and the Site are provided on an "as is" and "as available" basis to the fullest extent permitted by law. To the maximum extent permitted by law, AISG shall not be liable for any indirect, consequential, special, or punitive damages, or for any loss of data, profits, revenue, or business opportunity, arising from or related to your use of, or inability to use, the Site, such cataloguing information or any Dataset.
8. Indemnification
To the fullest extent permitted by law, you shall indemnify, defend, and hold harmless AISG, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against any and all claims, damages, costs (including legal costs), and expenses arising directly or indirectly from:
- your use of, or inability to use, any Dataset;
- your breach of any Dataset licence;
your breach of this Licensing Policy or our Terms;
where you are a Data Provider, any claim by a third party that your contributed Dataset, its associated license, or any metadata you have provided infringes that third party's rights or breaches any applicable law; and
- your violation of any applicable law.
9. Suspension, Removal and Termination
AI Singapore may suspend or terminate your access to the Site, or remove any cataloguing information on the Dataset from the Site, at any time, including (without limitation) if:
you breach this Policy, our Terms, or any applicable End User Licence;
we receive a complaint or claim alleging that a Dataset infringes a third party's rights, breaches data protection law, or otherwise breaches this Licensing Policy or applicable law;
- we are required to do so by law or by a regulatory authority; or
we determine that doing so is necessary to protect the integrity, security, or lawful operation of the Site.
The Disclaimers, Indemnification, Governing Law, and any other provision of this Licensing Policy required to give effect to termination or its consequences shall survive any termination of this Licensing Policy or removal of any cataloguing information on the Dataset.
10. Changes to Policy
We may update this Policy from time to time, such as to reflect changes in our practices or for legal reasons. We will post changes here and update the "Last updated" date at the top of this Licensing Policy. For material changes, we will use reasonable efforts to notify registered users (for example, by email or by an on-Site notice). Your continued use of the Site after changes have been posted constitutes your acceptance of the updated Policy.
Governing Law and Jurisdiction
This Licensing Policy is governed by the laws of Singapore. Any claim relating to this Licensing Policy shall be heard by Singapore Courts.
