Data Licensing Policy

This Licensing Policy (the "Policy") explains how dataset licensing works on the ATLAS-Data platform (the "Site"), operated by AI Singapore. It applies to all users who access, download, or otherwise use datasets made available through the Site, and to all contributors who provide datasets to the Site.

This Policy should be read together with our Terms of Use and Privacy Policy.

1. The Licensing Model

Datasets on ATLAS-Data are made available under licenses chosen and provided by each Data Provider. Some Datasets are contributed by third-party Data Providers; others are created and contributed by AI Singapore for open sharing. In each case, the applicable license is the one specified for that Dataset by its rights holder. AI Singapore does not impose a uniform license across Datasets.

When you download or otherwise use a Dataset, you enter into a license relationship with the Data Provider that contributed that Dataset (whether that Data Provider is a third party or AI Singapore itself), governed by the license that the Data Provider has applied to the Dataset.

2. No Platform Grant of Dataset Rights

Except where AI Singapore is itself the Data Provider for a particular Dataset, AI Singapore does not grant you any rights to use the Datasets through this Policy, our Terms of Use, or otherwise. Your rights to use any Dataset arise solely from the license accompanying that Dataset, regardless of whether the Data Provider is a third party or AI Singapore.

Before downloading or otherwise using a Dataset, you must review and accept the license that the Data Provider has applied to that Dataset.

3. Data Provider Obligations

When you contribute a Dataset to the Site, you represent and warrant that:

  • you have the legal right and authority to grant the license you have applied to the Dataset, including any necessary authorization from data subjects, employers, funders, or rights holders;
  • the license text you have provided is accurate, complete, and not misleading;
  • the Dataset was lawfully collected, including in compliance with applicable data protection laws (such as Singapore's Personal Data Protection Act 2012 ("PDPA"), the EU/UK General Data Protection Regulation ("GDPR"), and any other laws applicable to you or to the data subjects);
  • the Dataset does not contain personal data unless you have a lawful basis for sharing it on the terms applied;
  • the Dataset does not infringe any third party's intellectual property, privacy, contractual, or other rights;
  • the Dataset does not contain malware, malicious code, or content designed to harm users or systems; and
  • you have provided accurate metadata about the Dataset, including any information necessary for users to comply with the license you have applied.

You retain ownership of any intellectual property rights you hold in the Dataset. By contributing the Dataset, you grant AI Singapore a non-exclusive, royalty-free, worldwide license to host, store, display, transmit, index, and make the Dataset available to users on the terms you have specified, solely for the purpose of operating the Site. This license terminates when the Dataset is removed from the Site, except to the extent reasonably necessary to retain back-ups, audit logs, or other records for legal or operational purposes.

4. User Responsibilities

When you use a Dataset, you agree to:

  • read and comply with the license that the Data Provider has applied to that Dataset before downloading or otherwise using it;
  • provide attribution as required by the applicable license;
  • not attempt to re-identify any individual whose personal data has been anonymized or de-identified in the Dataset;
  • comply with all applicable laws, including data protection, intellectual property, export control, and sanctions laws;
  • comply with our Terms of Use and Privacy Policy; and
  • acknowledge that, where the Data Provider for a Dataset is a third party (not AI Singapore), AI Singapore is not a party to your license with that Data Provider and has no responsibility for any dispute between you and the Data Provider arising from your use of the Dataset.

5. Platform-Level Rules That Apply Regardless of Dataset License

Regardless of the license that any Dataset is provided under, you must not:

  • attempt to re-identify any individual whose personal data has been anonymized or de-identified;
  • use the Site or any Dataset to harass, defame, threaten, or harm any individual;
  • use the Site or any Dataset for any unlawful purpose;
  • bypass, disable, or interfere with the security features of the Site;
  • introduce malware, viruses, or any other harmful code to the Site or to Datasets you make available;
  • redistribute Datasets in a manner inconsistent with the applicable license; or
  • misrepresent the source, provenance, or licensing terms of any Dataset.

These rules apply in addition to the terms of each Dataset's license. To the extent any Dataset license purports to permit conduct prohibited by this section, the prohibition in this section prevails as a condition of using the Site.

6. Recommended Licenses for Contributors

To make Datasets easier for users to understand and adopt, we encourage Data Providers to use widely recognized open licenses where possible. The following are commonly used and well understood:

For data:

  • Creative Commons licenses (e.g., CC0 1.0, CC BY 4.0, CC BY-SA 4.0)
  • Open Data Commons licenses (e.g., ODC-By, ODbL, PDDL)

For accompanying code or software:

  • OSI-approved licenses (e.g., Apache 2.0, MIT, BSD)

Custom or bespoke license terms are permitted but are more difficult for users to evaluate and may reduce uptake of your Dataset. If you choose to apply a custom license, please make the terms as clear and unambiguous as possible, and consider stating which permissions are granted, which are not, and any conditions on use.

7. Disclaimers

AI Singapore makes no representations or warranties about any Dataset made available through the Site, including (without limitation) as to the accuracy, completeness, reliability, suitability, legality, or quality of any Dataset, the validity or enforceability of any Dataset license, or the rights of any Data Provider to make the Dataset available.

AI Singapore does not review or validate Dataset licenses on behalf of users. Users are responsible for satisfying themselves that they have the rights they need to use a Dataset for their intended purpose, and for understanding any conditions imposed by the applicable license.

Datasets and the Site are provided on an "as is" and "as available" basis to the fullest extent permitted by law. To the maximum extent permitted by law, AI Singapore shall not be liable for any indirect, consequential, special, or punitive damages, or for any loss of data, profits, revenue, or business opportunity, arising from or related to your use of, or inability to use, the Site or any Dataset.

8. Indemnification

To the fullest extent permitted by law, you shall indemnify, defend, and hold harmless AI Singapore, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against any and all claims, damages, costs (including legal costs), and expenses arising directly or indirectly from:

  • your use of, or inability to use, any Dataset;
  • your breach of any Dataset license;
  • your breach of this Policy or our Terms of Use;
  • where you are a Data Provider, any claim by a third party that your contributed Dataset, its associated license, or any metadata you have provided infringes that third party's rights or breaches any applicable law; and
  • your violation of any applicable law.

9. Suspension, Removal and Termination

AI Singapore may suspend or terminate your access to the Site, or remove any Dataset from the Site, at any time, including (without limitation) if:

  • you breach this Policy, our Terms of Use, or any Dataset license;
  • we receive a complaint or claim alleging that a Dataset infringes a third party's rights, breaches data protection law, or otherwise breaches this Policy or applicable law;
  • we are required to do so by law or by a regulatory authority; or
  • we determine that doing so is necessary to protect the integrity, security, or lawful operation of the Site.

The Disclaimers, Indemnification, Governing Law, and any other provision of this Policy required to give effect to termination or its consequences shall survive any termination of this Policy or removal of any Dataset.

10. Changes to Policy

We may update this Policy from time to time, such as to reflect changes in our practices or for legal reasons. We will post changes here and update the "Last updated" date at the top of this Policy. For material changes, we will use reasonable efforts to notify registered users (for example, by email or by an on-Site notice). Your continued use of the Site after changes have been posted constitutes your acceptance of the updated Policy.

Governing Law and Jurisdiction

This Policy is governed by the laws of the Republic of Singapore. The parties to this Policy submit to the exclusive jurisdiction of the courts of Singapore.

Definitions

In this Policy:

"AI Singapore", "we", "us", and "our" refer to AI Singapore.

"Data Provider" means any person or organization that contributes a Dataset to the Site. AI Singapore may itself be a Data Provider for Datasets it creates and contributes to the Site for open sharing.

"Dataset" means any collection of data made available through the Site by a Data Provider, which may include voice recordings, audio and text data, numerical data, images, documents, video, geospatial data, and other computer vision and/or multimodal data.

"Policy" means this Data Licensing Policy.

"Site" means the ATLAS-Data platform, available at https://atlas-data.sea-lion.ai.

"User" or "you" means any person who accesses or uses the Site, including to discover, download, or otherwise use Datasets.
